Following an unsuccessful planning application which had been submitted by another agent, our client approached us to see if we could suggest a way forward for this development. The client’s property was a large detached dwelling set within a substantial plot in the Green Belt. The proposal was for a detached swimming pool building set within the grounds and the application which was refused located this building closer to the highway than the dwelling, which meant the building required planning permission. As the site was located within the Green Belt, planning permission was not likely to be granted for a substantial outbuilding.
The property still had full Permitted Development Rights and following discussions with the client we were instructed to produce a set of drawings for an alternative scheme locating the pool building behind the dwelling. The proposals fell within the remit of the Permitted Development Rights of the property.
A full set of planning drawings were produced and the planning application was submitted to the Local Authority for a Certificate of Lawful Use or Development. A certificate was granted and therefore the client could construct the pool building in accordance with the submitted plans, with the reassurance that planning permission was not required for the development.
